Be Prepared For Litigation

I recently defended a client in an equine litigation matter. The complaint provided veterinarians’ names and some radiographs; however, there were substantial gaps in the pattern of the information provided. We issued subpoenas, and the responses to the subpoenas disclosed an entire year of missing records and some serious soundness issues in the records produced. This matter settled favorably for my client without the expense of a trial and expert witness testimony because we discovered major gaps in the plaintiff’s evidence.

  1. Collaboration between client and attorney is an integral part of case handling and includes verifying and uncovering all the facts;
  2. Preparing to win is essential in every case; equally important is constant case review with a client to evaluate possible settlement options, because settlement can sometimes be a less expensive alternative.
